全球治理中的争端解决机制
专题序言
争端解决机制是全球治理法律化的重要体现。世界贸易组织争端解决机制被称为该组织“皇冠上的明珠”，双边投资协定中投资者—国家争端解决机制则被视为此类协定中最具革命性的部分。当前，中国正积极建立“一带一路”争端解决机制和机构，争端解决机制在调节贸易关系方面的重要作用也亟待加强。本期学科动态以全球治理中的争端解决机制为主题，探讨了国际投资领域争端解决机制的新发展以及发展中国家的改革方案，分析了影响国际贸易领域争端解决的国内政治因素，并在比较视野下为中国在自由贸易协定中构建与劳工议题相关的争端解决机制提供有益参考。
